Terms of Agreement

For Individual Customers:-

By Accepting a Quotation, or current pricing via Telephonic conversation, email or WhatsApp, and accepting the electronic Terms & Conditions available on www.craftiness.co.za, the following Agreement between the Customer (You) and CraftiNess is initiated. Upon receipt/completion of the Project and full payment is received, this Agreement will be regarded as concluded.

For Businesses:-

By Accepting a Quotation, or current pricing via Telephonic conversation, email or WhatsApp, and accepting the electronic Terms & Conditions available on www.craftiness.co.za, the following Agreement between the Customer (You) and CraftiNess is initiated. This Agreement will be valid for the duration of the relationship between you and CraftiNess.

CraftiNess specifically provides items as per specifications supplied by you with regards to design, sizing, fabrics and materials. It is your own responsibility to ensure that any changes to the specifications are communicated before the purchase of materials or start of production. After this point, no further changes to the specifications can be applied.

If you are a Supplier (i.e., supplying the finished product to a third party), it is up to you to ensure all specifications sent through to CraftiNess are correct and accurate. CraftiNess cannot be held liable for any specification differences that may arise due to miscommunication between yourself and the third party. Upon acceptance of, completion of, and payment for the project, it will be deemed that the project has met the agreed upon requirements and quality. Thereafter, CraftiNess’ obligation to this agreement will be deemed met and concluded.

For CMT Services:-

By Accepting our current hourly rate via Telephonic conversation, email or WhatsApp, and accepting the electronic Terms & Conditions available on www.craftiness.co.za, the following Agreement between the Customer (You) and CraftiNess is initiated. This Agreement will be valid for the duration of the relationship between you and CraftiNess.

CraftiNess specifically provides items as per specifications supplied by you with regards to design and sizing. All materials are to be supplied. Acceptance of samples must be communicated before the start of production.

An hourly rate per person working for the duration of this Agreement will be invoiced on a monthly or bi-monthly basis, which will include detailed time sheets.  Any additional amounts due will also be included on the invoice.  Invoices will be submitted for payment due on the 26th of every month. 

Payment/Pricing Structure

A deposit of 50% of the total quoted price is required in order to commence with the project. The balance is payable upon receipt of the invoice, at the completion of the project.  All products remain the property of CraftiNess until fully paid for.

Pricing includes design, cutting, sewing, materials, maintenance, running costs and the time it takes to create your item.

A detailed tracking of hours worked for design research, pattern creation and assembly will be kept for reference, if needed.

There is a 5 to 10 working day lead time on all items, from date of Deposit/Payment.

For urgent items, a “Rush Surcharge” of 30% will be added to the amount due and will appear on the invoice.

Drop-off/Delivery/Collection

If materials are being supplied, they must be dropped off at the CraftiNess premises, unless otherwise agreed upon. During the order process you will be informed about delivery or collection options.

If delivery is required, you must ensure that delivery information and contact details are correct. Delivery options will be provided through a third party delivery service. All third party delivery service costs will be for your account and are added to the invoice due. Delivery times will be based on third party delivery service terms and conditions.  Tracking details will be provided to you after collection of your parcel from the third party delivery service. Thereafter, tracking and monitoring of the third party delivery service becomes your responsibility. CraftiNess cannot be held responsible or liable for losses, inconveniences, costs or damage resulting from any third party delivery service.

Collection must be made from the Craftiness premises, unless otherwise agreed upon.

Complaint

You have the right to file a complaint regarding any defects on your product within 7 days of receipt of the items purchased. You will need to prove that any defects detected were not caused by misuse or mishandling of the product, or improper observance of the supplied care instructions.

CraftiNess reserves the right to repair, remake or re-deliver an item. In this instance, the item needs to be returned to CraftiNess. Any items for which a refund has been paid, must be returned to CraftiNess.

Tolerances

CraftiNess provides items according to specifications supplied by you with regards to design, sizing, fabrics and materials.

Clothing items are made using standard metric sizing for South Africa. CraftiNess cannot guarantee that an item in a standard metric size will have a perfect fit. When choosing sizing options, you need to ensure that the correct sizing is used. If custom sizing is requested, you need to ensure that these measurements are as accurate as possible.

NB: A slight variance from the original pattern used is factored in for hems, seams, etc.

In some cases, visible transfer marks, or marks from pressing, can be left on the item. These usually disappear without any extra treatment during the first wash. Items made from different rolls of fabric may differ slightly in shade of colour or print, due to normal variations in the dying/printing process. CraftiNess cannot be held liable for these variances.

Conformance

Items shown in the CraftiNess Gallery or in photographs are a visualization only. The final product may vary somewhat in construction and colour. The perception of colours can vary on different device displays.

Therefore, the images do not depict an exact colour, but rather a guideline thereof. In order to select the right colour or feel of fabric, it is suggested that you personally supply the fabric/materials needed. If CraftiNess purchases any fabrics/materials on your behalf, it is deemed that the correct and approved colours or fabrics have been used.

Ownership

CraftiNess’ mission is to provide a high quality and personalized service, offering cost-effective and value-added products to you.

Pricing is based on individual product and customer requirements. Although all products are based on personal requirements, all items designed from scratch, or from imagery/sizing provided, all designs or reproduction thereof remain the intellectual property of CraftiNess.

All store bought patterns/designs remain the intellectual property of that designer/creator.

Advertising

Although most items are designed as blanks (for resale purposes), CraftiNess reserves the right to advertise said items on all CraftiNess social media/advertising platforms. If items are specifically branded by a third party, such parties will get advertising credit for their part of creating said product/item.

Personal Information

No personal information will be shared, in compliance with POPIA.

No particulars pertaining to CraftiNess, its owner or employees, may be shared without expressed permission.

Betrayal of confidentiality, slander or defamation in any sense against CraftiNess, its owner or employees, will result in an immediate cancellation of this Agreement, and may also result in legal action being taken.
